Industry Canada’s Transparency Reporting Guidelines

On June 30, 2015, Industry Canada released guidelines for businesses who proactively elect to publish accounts of how often, and under what circumstances, they provide information about their customers and clients to government authorities or law enforcement.

The guidelines were prepared to help private organizations be open with their customers but also provide the public with a good sense of the permissive non-consensual disclosures available to organizations. They take into account the amendments to Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) that recently came into force.

The guidelines cover categories of disclosures and provide an account of the types of court orders that organizations may be served with. A useful template table is also provided to give businesses a sense of the level of detail that can be made available when providing information on disclosures to stakeholders.
