The California Consumer Privacy Act 2018 (CCPA) grants California residents new rights regarding their personal information and imposes various data protection duties on certain entities conducting business in California. The CCPA applies to businesses that have gross revenues in excess of USD 25 million. That said, it could apply to organizations that earn less than this in cases where the business:
- Annually buys, receives for commercial purposes, sells or shares for commercial purposes, the personal information of 50,000 or more consumers, households or devices.
- Derives 50% or more of its annual revenues from selling consumers' personal information.
The California Attorney General may bring actions for civil penalties of $2,500 per violation, or up to $7,500 per violation if intentional.
